Neutra
Legal.
Our goal is to avoid collecting, recording, or analysing any data about you, our users. By using our app and visiting our website, however, some data is automatically generated without any action on our part. In the following, we will provide some examples and go into details.
App
Data generated by the app and provided to us by Apple App Analytics are always anonymised and used to improve the app (e.g. crash logs). Purchasing a subscription in the app means that Apple knows what you bought, but we don’t, nor do we know your Apple ID. Hence the publications do not know who is reading their content, only how many people in total.
If you contact us, we’ll store your e-mail address for the purpose of customer support. We will never share your address with any third parties, and we won’t send you any unsolicited information about Neutra. Our mail servers are located in Geneva, Switzerland (which is not part of the EU).
Network
All transfers from and to our servers are encrypted and no cross-site tracking takes place. Our content delivery partners, Infomaniak and KeyCDN, are both headquartered in Switzerland, with servers around the globe.
Newsletter
If you subscribe to our newsletter (not available at the moment), we’ll store your e-mail address for the purpose of sending you the newsletter. The moment you unsubscribe, we’ll delete it.
Real, Physical Mail
If you send us letters or postcards on paper, they will either be taped to the fridge (if praise) or filed in a folder (if criticism). Our office is locked up daily, but it is cleaned by an external company outside office hours.
Web
When visiting our web page, information such as your IP address and browser version is stored in our web server logs and used to improve the service. In addition, our CMS Kirby sets a cookie to keep track of your browser language. We do not use external analytics tools. The data mentioned here is never shared outside of our own web infrastructure.
Terms of Service
Version 1.1 – October 28, 2022
I. Scope of application
The following General Terms & Conditions govern the relationship between Neutra, LLC (“Neutra”), and the users ("users") of the app, website and services ("app") offered by Neutra. The Terms of Service are binding for all users; with the use of the app, they are automatically accepted.
II. Terms of use
1. Scope
The app is intended exclusively for personal, private, non-commercial use by natural persons. Other forms of use, such as the manual or automated retrieval of information and its forwarding to other, analogue or digital systems, are not permitted. In addition, the provisions under section II/4 (copyright and other intangible rights) apply.
A valid Apple ID is required for the use of paid publications in the app. Users undertake to use their login name and password in accordance with the GTC of the App Store and in particular not to make them accessible to third parties. Users are responsible for the protection of this data.
2. Services provided by Neutra
In general, the app is available 365 days a year, 24 hours a day. The operating hours may be restricted by Neutra at any time for technical or organisational reasons. Likewise, the app can be changed in content, form or function at any time; any saved (marked) articles or settings can be deleted as a result.
Any contractual relationship between the users and Neutra depends on the way in which the app is used, i.e. whether paid or free publications are consumed. For the latter form of use, Neutra does not guarantee any services such as up-to-dateness or availability.
3. Liability
Neutra shall only be liable for the non-delivery or incorrect delivery of paid publications. Neutra must be proven to have acted with intent or gross negligence and the liability shall in any case be limited to the amount charged to the users for the publication in question. In any case, technical problems must be reported to Neutra immediately.
Neutra is not liable for any damages or consequential damages arising from the use of the app or its content. In particular, Neutra is not liable for the content or errors of third parties. Although the displayed content is created with due care, Neutra can in no case guarantee its topicality, relevance, accuracy or completeness and therefore disclaims any liability. The copyrights and property rights of third parties are not affected by the display in the app; users are responsible for compliance with these rights and bear the risk in the event of any misuse.
Neutra is in no way liable for damage caused by incorrect operation of the devices, such as the installation of computer viruses and spyware and their consequences. Likewise, Neutra is not liable for operational interruptions, network problems, malfunctions or their consequential damages that are related to the technical further development of the app.
4. Copyright and other intangible rights
Neutra as the author of the app including its design and technology reserves all rights. All editorial content such as texts, images, videos and other components of articles and publications are subject to the copyrights of third parties. Changing, duplicating, copying, selling or redistributing this content is expressly prohibited. The forwarding of articles to third parties is only permitted within the framework of the functionality within the app in accordance with clause II/1.
5. Conclusion, duration and termination of the contract
Publications subject to a charge can only be paid for and cancelled via the App Store infrastructure; Apple's provisions regarding in-app purchases apply. All prices, which Neutra may adjust at any time, are shown inclusive of VAT. Each subscription to a paid publication is valid for either a) one hour without automatic renewal or b) one month with automatic renewal for a further month if it has not been cancelled beforehand. Cancellation can be made at any time, but it only becomes active after the current subscription period has expired.
III. Final provisions
1. Applicable law and place of jurisdiction
All legal relationships between Neutra and the users are subject to Swiss substantive law. The place of jurisdiction in the event of disputes shall be Zurich, as the registered office of Neutra, LLC, subject to the reservation of deviating, mandatory places of jurisdiction.
2. Severability clause
Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a new provision that comes as close as possible to the invalid provision in economic and legal terms.
3. Changes
Neutra reserves the right to change the terms of use at any time and without notice. Corresponding amendments will be published on the Neutra website. It is the responsibility of the users to inform themselves about the currently valid version.
